1. The Service
Sortle lets you:
- scan trading cards with your device camera or upload photos, and match them to our card catalogue;
- keep a collection and stock inventory with conditions, quantities, prices and storage labels;
- connect your own eBay account and Shopify store and create, update, end and keep in sync listings on those marketplaces from your Sortle inventory;
- view orders from connected marketplaces so you can pick, pack and print shipping labels.
We may add, change or remove features over time. We will give you reasonable notice of any change that materially reduces what you have paid for, and if you do not accept it you may cancel and receive a pro-rata refund of any prepaid fees for the remainder of your billing period.
2. Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract.
- You must give accurate information when you register and keep it up to date.
- You are responsible for keeping your password secure and for everything done under your account. Tell us immediately at nick@sortle.io if you suspect unauthorised access.
- One person per account. You may not share, sell or transfer your account.
- While the Service is in beta, access may require approval and we may limit the number of accounts.
3. Fees and subscriptions
Sortle is a paid service; there is no free tier. The same plans are offered on two billing channels. If you installed the Sortle app for Shopify, your plan is chosen and billed only through Shopify App Pricing and appears on your Shopify bill. If you signed up on sortle.io, your plan is billed on sortle.io through Stripe. Each account is billed on exactly one channel, fixed when the account first subscribes or installs the Shopify app. Card scanning is included with an active subscription and is not sold separately. Current prices are shown in the Service and are in United States dollars (USD), exclusive of any GST or other taxes that may apply and be added at checkout:
- Standard: $5.00 per month, one connected marketplace at a time, with scanning included. On sortle.io you may change which marketplace holds that place once every 30 days; on a Shopify-billed plan the marketplace is the Shopify store the app is installed on, and eBay requires Multi-platform.
- Multi-platform: $15.00 per month, all supported marketplaces and cross-platform listing, with scanning included.
3.1 Billing
- Payments for Sortle plans bought on sortle.io are processed by Stripe. Plans bought through the Shopify app are billed by Shopify under Shopify's terms. Sortle does not charge Shopify-billed accounts outside of Shopify, and does not sell scan packs. By subscribing you authorise the applicable charge each month until you cancel.
- Subscriptions renew automatically. You can cancel at any time from Billing → Manage subscription in your dashboard (sortle.io billing) or from the app's plan page in your Shopify admin (Shopify billing); your plan stays active until the end of the current billing period and is not renewed. Uninstalling the Shopify app cancels a Shopify-billed plan.
- If a payment fails we will retry it and notify you. If it remains unpaid we may suspend paid features until payment is made.
- We may change our prices. We will give you at least 30 days' notice by email before a price change applies to your subscription; if you do not agree you may cancel before it takes effect.
3.2 Free trial
New accounts billed on sortle.io may receive one free trial of 30 days of the Standard plan, with scanning included. Any trial on a Shopify-billed plan is set on the plan in Shopify. At the end of the trial your subscription converts to the paid Standard plan unless you cancel before the trial ends. We will remind you by email before the trial ends.
3.3 Refunds
Because the Service is a monthly subscription you can cancel at any time, we do not offer refunds for a billing period that has already started, except where the Australian Consumer Law or these terms require it (for example under sections 1, 3.1 or 9). If you believe you have been charged in error, contact us and we will investigate and refund any incorrect charge.
If you are a consumer in the European Union or United Kingdom you have a statutory right to cancel a paid subscription within 14 days of buying it without giving a reason, by emailing nick@sortle.io. Because the Service starts immediately at your request, we may deduct a proportionate amount for the part of the period already used; the rest is refunded within 14 days.
4. Marketplace connections (eBay and Shopify)
- When you connect eBay or Shopify you authorise Sortle to access and act on your marketplace account to the extent of the permissions you grant, including creating, updating and ending listings, adjusting inventory and reading orders.
- You remain the seller of record. You are responsible for every listing, price, description, shipment, refund and customer interaction on your marketplace accounts, and for complying with eBay's and Shopify's terms, policies and fees, and with any applicable laws, including consumer and tax law.
- We are not a party to any sale between you and your buyers.
- You can disconnect a marketplace at any time in Settings → Stores or by uninstalling the app from the marketplace. Disconnecting stops synchronisation but does not remove listings already on the marketplace.
- eBay and Shopify are independent services that may change their APIs, policies or availability. We are not responsible for their actions or outages, and a connection may stop working as a result.
- You must not use Sortle to create listings that breach a marketplace's rules, that you are not entitled to sell, or that are counterfeit or misdescribed.
5. Your content
- You own the photos, inventory data, prices, notes and templates you put into the Service (Your Content).
- You grant us a licence to host, copy, process and transmit Your Content only as needed to provide the Service to you, including sending it to the marketplaces you connect and to our processors described in the Privacy Policy.
- Card photos you scan are stored on the matching cards in your collection. You grant us a perpetual, royalty-free licence to use de-identified copies of those photos to improve card recognition.
- If you enable a public showcase link, the collection or stock you choose to share becomes visible to anyone with the link until you disable it.
- You must have the right to upload Your Content and it must not infringe anyone else's rights or contain unlawful material.
6. Acceptable use
You must not:
- use the Service for anything unlawful, fraudulent or misleading;
- attempt to access another user's account or data, or probe, scan or test the security of the Service without our written permission;
- scrape, bulk-download or resell our card catalogue, pricing data or images, or use automated tools to access the Service other than through features we provide;
- upload malware or content that infringes intellectual property, or interfere with the operation of the Service;
- circumvent plan limits, scan-credit accounting or marketplace connection limits.
7. Intellectual property
- The Service, its software, design, card catalogue compilation and the Sortle name and logo are owned by us or our licensors and are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable licence to use the Service in accordance with these terms.
- Pokémon, Pokémon TCG, Magic: The Gathering, One Piece, Riftbound, other game names, card names, card text and card artwork are trademarks and copyright of their respective owners (including Nintendo, The Pokémon Company, Wizards of the Coast and others). Sortle is an independent inventory tool. It is not affiliated with, endorsed by, sponsored by or approved by those owners. Catalogue images and market prices come from third-party data sources and are used only to help you identify and value cards you already hold. You must not use the Service to reproduce, sell or distribute official card artwork except as those owners and the marketplaces you use allow.
8. Card recognition, prices and third-party data
- Card recognition is automated and may misidentify a card. Check every match before listing or relying on it.
- Prices shown are estimates derived from third-party market data and are for information only. They are not valuations, financial advice or a guarantee of what a card will sell for.
- Marketplace data (listings, inventory, orders) is provided by eBay and Shopify and may be delayed or incomplete.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), including that they will be provided with due care and skill, be fit for any purpose you told us about, and be supplied within a reasonable time. For a major failure you are entitled to cancel the Service and receive a refund for the unused portion, or compensation for the reduced value; for other failures you are entitled to have the problem fixed within a reasonable time or, if it is not, to cancel and receive a refund for the unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot be excluded.
10. Liability
To the extent permitted by law and subject to section 9:
- the Service is provided on an “as is” and “as available” basis; we do not promise it will be uninterrupted or error-free;
- we are not liable for loss caused by the acts or omissions of eBay, Shopify, our payment processor, sign-in providers or other third parties, by misidentified cards or inaccurate price data that you did not check, or by your breach of these terms;
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill;
- our total liability to you for all claims in any 12-month period is limited to the amount you paid us in that period, or if the ACL applies and permits it, to resupplying the Service or paying the cost of resupply.
You are responsible for keeping your own backup of Your Content. You can export it at any time from Settings → Data Management.
11. Privacy
Our Privacy Policy explains what personal information we collect, how we use it, where it is stored (including overseas) and how you can access, correct or delete it. It forms part of these terms.
12. Suspension and termination
- By you: you may stop using the Service at any time. To close your account, use Settings → Data Management → Delete All My Data, which permanently deletes your account and data, or email us. Cancel any subscription first to avoid further charges.
- By us: we may suspend or terminate your account if you materially breach these terms, if we are required to by law or a marketplace, or if we discontinue the Service. Except where you are in serious breach, we will give you at least 30 days' notice and refund any prepaid fees for the period after termination.
- On termination your licence to use the Service ends, your marketplace connections are disconnected, and your data is deleted in accordance with the Privacy Policy. Listings already on a marketplace remain there and are your responsibility.
13. Changes to these terms
We may update these terms when the Service or the law changes. The effective date at the top shows the current version. For changes that reduce your rights or increase your obligations we will give you at least 30 days' notice by email or in the Service before they take effect. If you do not agree to a change you may cancel and receive a pro-rata refund of prepaid fees. Continuing to use the Service after a change takes effect means you accept it.
14. General
- Governing law: these terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia. If you live outside Australia, this does not deprive you of the protection of mandatory consumer laws in your country.
- Disputes: contact us first at nick@sortle.io and we will try to resolve the issue with you within 30 days.
- Electronic messages: we send service emails (account, billing, security and beta notices) only. We do not send marketing email. If that changes, we will only send commercial electronic messages with your consent and with a functional unsubscribe, as required by the Spam Act 2003 (Cth).
- Severability: if any part of these terms is unenforceable, the rest continues to apply.
- Assignment: you may not assign these terms. We may assign them to a successor of the business on notice to you.
- Entire agreement: these terms and the Privacy Policy are the whole agreement between you and us about the Service.
